Terms of Service

Effective Date: January 1, 2025

These Terms of Service ("Agreement") govern the rental and use of photo booth services provided by LudovicoBooths ("Company," "we," "us," or "our"). By booking our services, the Client ("Client," "you," or "your") agrees to be bound by these terms.

1. Services

LudovicoBooths provides photo booth rental services for private, corporate, and public events. Services may include equipment setup, operation, photo printing, digital sharing, custom overlays, props, and other features as specified in the booking agreement.

2. Booking and Payment

2.1 Reservation

A booking is confirmed only after:
  • A signed agreement is received; and
  • The required booking retainer has been paid.

2.2 Payment Schedule

  • A non-refundable retainer of 25% of the total booking fee is required to reserve the event date.
  • The remaining balance must be paid no later than 14 days before the event date unless otherwise agreed in writing.
  • Bookings made within 14 days of the event require full payment at the time of booking.

2.3 Late Payments

Failure to make payments by the specified due dates may result in cancellation of services without refund of any amounts previously paid.

3. Cancellation and Refunds

All cancellations and refunds are governed by LudovicoBooths' Cancellation and Refund Policy, which forms part of this Agreement.

4. Event Requirements

The Client agrees to provide:

  • Adequate space for booth setup and operation.
  • Access to a standard electrical outlet within reasonable distance of the setup area.
  • Safe and unobstructed access for loading, unloading, setup, and removal.
  • Any required venue permissions or approvals.

Failure to provide these requirements may limit or prevent service delivery without entitlement to a refund.

5. Setup and Operation

  • LudovicoBooths typically requires 60–90 minutes for setup and up to 60 minutes for teardown.
  • Setup and teardown times do not count toward booked rental hours unless otherwise agreed.
  • The Company reserves the right to adjust booth placement if required for safety or operational reasons.

6. Client Responsibilities

The Client is responsible for:

  • Ensuring guests use the equipment safely and appropriately.
  • Preventing misuse, vandalism, or theft of equipment.
  • Supervising minors using the booth.

The Client may be held financially responsible for damage caused by the Client, guests, vendors, or attendees.

7. Equipment Damage or Loss

The Client agrees to reimburse LudovicoBooths for repair or replacement costs resulting from:

  • Intentional damage
  • Negligence
  • Theft
  • Vandalism
  • Misuse of equipment

Normal wear and tear is excluded.

8. Venue Delays and Interruptions

LudovicoBooths is not responsible for interruptions caused by:

  • Venue restrictions
  • Power outages
  • Internet outages
  • Event schedule delays
  • Weather conditions
  • Acts of third parties

No refunds will be issued for lost operating time resulting from these circumstances.

9. Overtime Services

  • Additional service hours requested during the event are subject to availability and will be billed at the current hourly rate.
  • Payment for overtime may be required before service is extended.

10. Photo and Video Content

10.1 Client Ownership

The Client receives a personal, non-exclusive license to use photos and digital content generated during the event.

10.2 Marketing Authorization

Unless otherwise requested in writing before the event, the Client grants LudovicoBooths permission to use event photos, videos, and booth images for:

  • Marketing
  • Social media
  • Website galleries
  • Advertising materials

Clients may opt out at any time prior to the event by written notice.

11. Privacy

  • LudovicoBooths collects only information reasonably necessary to provide services.
  • Personal information will be handled in accordance with applicable privacy laws and will not be sold to third parties.
  • Guest photos may be stored electronically for delivery, backup, and customer support purposes.

12. Limitation of Liability

To the maximum extent permitted by law:

  • LudovicoBooths shall not be liable for indirect, incidental, special, or consequential damages.
  • Total liability arising from any claim shall not exceed the total amount paid by the Client for the booking.
  • This limitation applies regardless of the legal theory under which a claim is brought.

13. Equipment Failure

While we maintain and test all equipment regularly, technical failures may occasionally occur.

If equipment failure substantially prevents service delivery, LudovicoBooths' liability shall be limited to a partial or full refund proportional to the affected service period.

14. Force Majeure

Neither party shall be liable for failure to perform due to circumstances beyond reasonable control, including:

  • Natural disasters
  • Severe weather
  • Government restrictions
  • Public emergencies
  • Strikes
  • Utility failures
  • Acts of terrorism
  • Venue closures

Affected obligations will be suspended during the period of disruption.

15. Indemnification

The Client agrees to indemnify and hold harmless LudovicoBooths, its owners, employees, contractors, and representatives from claims, damages, losses, liabilities, and expenses arising from:

  • Client negligence
  • Guest misconduct
  • Venue-related incidents
  • Violations of this Agreement

16. Governing Law

This Agreement shall be governed by and interpreted under the laws of the Province of Ontario and the laws of Canada applicable therein.

Any disputes arising from this Agreement shall be resolved in the courts located in Ontario, Canada.

17. Severability

If any provision of this Agreement is determined to be unenforceable, the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms of Service, together with the booking agreement and Cancellation & Refund Policy, constitute the entire agreement between the parties and supersede any prior discussions or understandings.
